Abstract
The phenomenon of husbands or wives who continue to maintain their marriages despite having spouses with mental disabilities represents a social reality that challenges the normative construction of Islamic family law, which is generally built upon assumptions of ideal and fully functional spousal relations. In this context, this study examines three main issues: the reasons why husbands or wives remain in marriages with partners experiencing mental disabilities; the challenges and strengthening potentials of family resilience they encounter; and the position of the fulfillment of spouses’ rights and obligations under such conditions. This research employs a qualitative method with a phenomenological approach and was conducted in Margasari Village, Sidareja Subdistrict, Cilacap Regency. Data were collected through in-depth interviews with married couples in which one spouse experiences mental disability and documentation. Data analysis was carried out using the Family Strength Framework proposed by Nick Stinnett and John DeFrain to examine family resilience dynamics, alongside the Maqa>s}id al-Usrah theory formulated by Jamaluddin ‘Athiyyah as a normative framework for assessing Islamic family law principles. The findings reveal that the decision to remain in marriage is driven by moral commitment, religious belief, and a sense of responsibility toward the family. The main challenges faced include dual role burdens, social stigma, economic pressure, uncertainty about the future, and imbalance in the fulfillment of spouses’ rights and obligations. Nevertheless, family resilience is strengthened by several supporting factors, including spirituality, enduring affection and commitment, adaptive capacity developed through experience, and support from extended family members, local communities, and community leaders. From the perspective of maqāṣid al-usrah, the fulfillment of spouses’ rights and obligations in families with mentally disabled partners is flexible and contextual, oriented toward preventing harm and realizing family welfare. This study concludes that family resilience in such circumstances does not contradict Islamic family law principles, but rather reflects the application of substantive justice in line with the objectives of Islamic law in preserving family continuity and harmony.
