Abstract

The phenomenon of mothers dominating the role of providing for orphaned children shows a significant change in the structure of modern families. In Wedomartani Village, mothers of orphaned children not only play a role in caring for their children, but also become the main breadwinners for the family after the father's death. The limited involvement of the father’s relatives and the community’s legal literacy regarding the obligation to support orphaned children reveal an discrepancy between Islamic legal norms and social practices. In this context, the mother’s role has become increasingly central as the extended family, once a collective support system, to the nuclear family. This study employs field research with a sociological approach. The research data were collected through interviews, observation, and documentation. Interviews were conducted with 13 single mothers who cared for their children after their husbands died, two community leaders, one person from the husband's family, and two religious leaders in the Wedomartani area. Additional data were obtained from secondary sources, including fiqh literature, academic articles, national reports, and global data related to the practice of child support responsibilities. The collected collected data were processed qualitatively and analyzed using Alice H. Eagly and Wendy Wood's Social Role Theory, then presented descriptively and anatically. The results of the study show that the dominance of the mother's role in providing for and caring for orphaned children is a social construct influenced by community expectations and the father's family circumstances, such as economic factors, understanding, and absence (death or distance). In practice, the pattern of providing for the children in Wedomartani is closer to the views of the Maliki and Shafi'i schools of thought because the majority of mothers are the main providers, while a small number receive support from relatives as per the views of the Hanafi and Hanbali schools of thought. Although this practice is not entirely in line with fiqh, in substance it does not contradict the substantive principle of Islamic law. This emphasizes the importance of strengthening Islamic legal literacy, enchance the economic empowering of single mothers, and optimizing legal regulations and the social role of the family to ensure the fair maintenance rights of orphans.
