Abstract

The practice of unregistered marriage conducted through non-civil servant (Non-PNS) marriage officiants remains prevalent in South Banjarmasin District, despite the existence of state regulations governing marriage registration. This phenomenon is influenced by various social, economic, cultural, and religious factors, including economic constraints, low legal literacy, and strong religious legitimacy granted by local religious figures. In this context, unregistered marriage is perceived as a practical solution to preserve family honor and avoid social stigma, although it potentially leads to legal problems and the lack of protection for women’s and children’s rights. This study employs a qualitative approach with a descriptive-analytical design within the perspective of the sociology of law. Data were collected through in-depth interviews, observation, and documentation involving community members, Non-PNS marriage officiants, religious leaders, and other relevant parties. The analysis integrates Peter L. Berger’s theory of social construction to examine how the practice of unregistered marriage is formed and sustained, alongside the framework of Maqāṣhid al-Sharī‘ah proposed by Imam al-Shāṭibī to assess its conformity with the fundamental objectives of Islamic law. The findings indicate that unregistered marriage is a product of social construction that has become internalized as a practice considered normal and morally legitimate in religious terms. However, from the perspective of Maqāṣhid al-Sharī‘ah, this practice fulfills maslahat only at the moral level while contradicting the broader objectives of Islamic law, particularly in terms of protecting life, lineage, property, and the rights of women and children. Therefore, this study emphasizes the importance of marriage registration as both a sharī‘ahbased and state legal instrument to realize maslahat and justice within family life.
