Abstract

Sexual violence against children constitutes a form of human rights violation that causes serious and long-lasting impacts on victims, both physically and psychologically. The state has an obligation to provide comprehensive legal protection to children as victims, as stipulated in Law Number 12 of 2022 on the Crime of Sexual Violence (UU TPKS). This study aims to analyze the implementation of legal protection for child victims of sexual violence by the Regional Technical Implementation Unit for the Protection of Women and Children (UPTD PPA) of Bantul Regency, as well as to identify the obstacles encountered in the implementation of such protection. This research employs an empirical legal research method (juridical-empirical). This approach is used to examine how legal provisions concerning the protection of child victims of sexual violence are implemented in practice by UPTD PPA of Bantul Regency. The data consist of primary data obtained through interviews with UPTD PPA officers and relevant stakeholders, as well as observations of the implementation of protection services. Secondary data were collected through library research on laws and regulations, legal literature, scientific journals, and relevant official documents. All data were qualitatively analyzed using Philipus M. Hadjon’s theory of legal protection and Benjamin Mendelsohn’s victimology theory as analytical frameworks. The results of the study indicate that UPTD PPA of Bantul Regency has implemented legal protection for child victims of sexual violence through various services, including complaint handling, victim outreach, case management, temporary shelter, and legal and psychological assistance. Prevention programs have also been carried out in various forms, encompassing community socialization and education, dissemination of information through digital media, and cross-sectoral coordination and cooperation with relevant institutions. In principle, the implementation of these services is in line with the provisions of the UU TPKS and reflects protective efforts that position children as completely innocent victims who are entitled to optimal protection and recovery. However, the effectiveness of legal protection continues to face several challenges, including low public awareness, the vulnerability of victims’ families due to power relations and economic dependency, limited human resources within UPTD PPA, as well as obstacles in evidence gathering and legal proceedings. These challenges indicate that legal protection for child victims of sexual violence has not yet been fully oriented toward a victim-centered paradigm.
