Abstract

This research examines the implementation of campaign supervision in the 2024 Yogyakarta City Regional Head Election (Pilkada) by the Election Supervisory Body (Bawaslu). The 2024 Pilkada presented complex challenges characterized by political anomalies in party coalitions and massive potential for violations, including vote buying (money politics), civil servant (ASN) neutrality issues, and violations regarding Campaign Props (APK). This study aims to analyze how supervision regulations are applied in the field and to review them from the perspective of Maqashid Shari'ah. This research employs a juridical-empirical method with a descriptive-evaluative nature. Data were collected through in-depth interviews with Bawaslu Commissioners, District Election Supervisors (Panwascam), and community leaders, supported by documentation studies. The analysis utilizes Lawrence M. Friedman's Legal Culture Theory to dissect legal effectiveness and Imam Asy-Syatibi's Maqashid Shari'ah Theory for a review based on Islamic values. The results indicate that the implementation of supervision by Bawaslu Yogyakarta City is influenced by two dimensions of legal culture. Regarding internal legal culture, limited human resources drove a strategic shift from prosecution to adaptive prevention. Conversely, regarding external legal culture, supervision faced challenges arising from community pragmatism and low compliance among election participants, evidenced by 574 points of APK violations and allegations of money politics. From the Maqashid Shari'ah perspective, the supervision conducted by Bawaslu has realized the protection of five fundamental principles: safeguarding religion (hifz al-din) from the politicization of SARA, safeguarding life (hifz al-nafs) through the removal of hazardous APKs, safeguarding intellect (hifz al-aql) from disinformation, safeguarding lineage (hifz al-nasl) by prohibiting child involvement in campaigns, and safeguarding property (hifz al-mal) through the crackdown on money politics practices.
