Abstract

This research is prompted by a 13-year delay in following up on the Constitutional Court Decision Number 79/PUU-IX/2011, which led to the enactment of Law Number 61 of 2024. The academic concern centers on the phenomenon of legislative omission, which undermines legal certainty, and the potential violation of the principle of efficiency—a key indicator of good governance—following the removal of the limit on the number of ministries. Utilizing a juridical-normative research method with a statute approach and case approach, this study aims to analyze the legal implications and the follow-up shape of the law on governance, as well as to review the legislative process through the perspective of the theory of legislation. The results indicate that Law No. 61 of 2024 has substantively achieved harmonic normalization by eliminating the ambiguity surrounding the position of Vice Minister and reaffirming the status of ministers as a position of trust (trusteeship). However, theoretically, the thirteen-year legislative delay reflects the weak enforceability of constitutional decisions within Indonesia’s political-legal practice. Viewed through the lens of good governance, while the flexibility in the number of ministries provides executive responsiveness, this policy carries a high risk of compromising efficiency due to potential bureaucratic obesity and political patronage. As a solution, this research suggests the necessity of a constitutional complaint mechanism to prevent future disregard for punishment of follow-up constitutional court decisions and to ensure that regulatory formation remains grounded in bureaucratic effectiveness.
