Abstract

The widespread circulation of illegal cosmetics in Indonesia indicates persistent problems within the cosmetic supervision system, particularly amid the increasing complexity of digital trade. This condition positions the Food and Drug Supervisory Agency (BPOM) as a key institution in ensuring public health protection. The Special Region of Yogyakarta is one of the areas with a significant number of illegal cosmetic findings. This research focuses on the Balai Besar POM DI Yogyakarta with the aim of analyzing the effectiveness of supervision over illegal cosmetic distribution and examining the form of institutional accountability based on the theory of legal effectiveness and the concept of amanah. This study employs an empirical juridical method using statute approach, conceptual approach, and field approach. Primary data were obtained through observation and interviews with officials of Balai Besar POM DI Yogyakarta, while secondary data were collected through literature study of relevant laws and legal materials. The data were analyzed descriptively and analytically to assess the conformity between legal provisions and their implementation in practice. The results show that the supervision of illegal cosmetics by Balai Besar POM DI Yogyakarta has normatively been carried out through pre-market and postmarket mechanisms, including cyber surveillance and administrative enforcement. However, its effectiveness has not been fully optimal due to limitations in human resources and facilities, the low level of business compliance, and consumer behavior patterns. From the perspective of the concept of amanah, BPOM has carried out its public responsibility through supervision, education, and interagency coordination. Nevertheless, strengthening moral responsibility, transparency, and public participation remains necessary to achieve more effective public health protection.
