Abstract

False claims on processed food labels constitute the provision of information that does not correspond to the objective condition of a product, thereby potentially causing both material and immaterial losses to consumers. This study analyzes the practice of labelling gluten-free claims on BNG bakery products. It examines the forms of violations against the Indonesian Food and Drug Authority Regulation Number 1 of 2022 concerning the Supervision of Claims on Processed Food Labels and Advertisements. Furthermore, this study analyzes consumer protection based on Law Number 8 of 1999 concerning Consumer Protection and Law Number 18 of 2012 concerning Food, as well as evaluates gluten-free practices from the perspective of maqāṣid asy-syarī‘ah. This research is a normative legal study employing both a statute approach and a case approach toward the false claim practices found in BNG bakery products. Data collection methods include library research and documentation studies. The research is descriptive-analytical in nature, aiming to systematically and factually describe regulations relevant to the legal issues addressed in this study. The results of this study indicate that the gluten-free claim stated on BNG bakery product labels does not comply with the provisions of the Indonesian Food and Drug Authority Regulation Number 1 of 2022, as the products contain gluten exceeding the maximum threshold of 20 mg/kg. This practice results in the violation of consumers’ rights to accurate and safe information, as well as the right to choose and obtain goods in accordance with the agreed value, as stipulated in the Consumer Protection Law. Under the Food Law, this practice contradicts the obligation to meet food safety and quality standards, as well as labelling provisions that must not be misleading. From the perspective of maqāṣid asy-syarī‘ah, this practice is inconsistent with the principles of ḥifẓ al-nafs (protection of life), ḥifẓ al-‘aql (protection of intellect), and ḥifẓ al-māl (protection of property).
