Abstract
The profit-sharing practice from coffee bean sales between baristas and Hayati Coffee Roastery represents a form of business cooperation that has developed within the contemporary coffee industry. However, this practice has not been fully supported by clear formal contractual arrangements, raising questions about its compliance with Islamic legal principles. The main issues examined in this study are formulated into two research questions: how the profit-sharing practice from coffee bean sales between baristas and Hayati Coffee Roastery can be reviewed from the perspective of Islamic law, particularly in relation to the wakālah bil ujrah contract, and how Islamic law addresses the potential elements of gharar, riba, and injustice within the implementation of the practice. This study is a field research employing a qualitative approach with a descriptive-analytical nature. Data were collected through observation, interviews, and documentation conducted at Hayati Coffee Roastery. The data sources consist of primary data obtained from interviews with baristas and management, as well as secondary data derived from literature on fiqh muamalah, regulations, and Fatwa DSN-MUI No. 113/DSN-MUI/IX/2017. The analysis applies the theory of wakālah bil ujrah and the theory of justice in Islamic law as analytical frameworks to assess the validity of the contract and the distribution of rights and obligations among the parties. The findings indicate that the profit-sharing practice in coffee bean sales at Hayati Coffee Roastery is structurally more appropriate to be classified as a wakālah bil ujrah contract, in which baristas act as agents receiving ujrah for their sales services. The practice does not involve riba and does not directly lead to gharar as long as transparency and clear agreements are maintained. Nevertheless, from the perspective of justice, clearer contractual arrangements are needed to ensure that the distribution of compensation truly reflects the principles of justice, legal certainty, and sharia values in muamalah.
