Abstract

This study analyzes market control practices and alleged abuse of dominant position by Google LLC through the Google Play Billing System (GPBS) policy in KPPU Decision Number 03/KPPU-I/2024. The GPBS policy requires application developers to use Google's internal payment system with a service fee of 15–30%, which has caused controversy because it is considered to limit choices and increase developers' dependence on the platform. However, the Business Competition Supervisory Commission stated that Google was not proven to have violated Article 19 letters a and b of Law No. 5 of 1999, thereby sparking debate regarding the limits of market dominance assessment in the digital era. This study aims to analyze the conformity of the decision with competition law provisions, examine the Commission's considerations of the Commission Council in assessing Google's dominant position, and to review the decision through the perspective of Maqāṣid Asy-syarīʿah, particularly the principles of justice (al-‘adl), protection of property (ḥifẓ al-māl), and public interest. The method used is a literature study with a normative juridical and descriptive-analytical approach, based on primary, secondary, and tertiary legal materials. The results of the study show that Google has a dominant position in the Android application distribution market in Indonesia due to its control of the Google Play Store as the main infrastructure with high barriers to entry and limited substitutes. GPBS policies have the potential to strengthen this dominance through control over the payment system. From the perspective of maqāṣid according to Muhammad al-Tahir Ibnu ‘Āshūr, this practice does not fully reflect the protection of property and distributive justice. This study recommends strengthening competition regulations in the digital sector to create a fair and sustainable economic ecosystem.
