Abstract
This study examines the mechanisms for enforcing the law against violations of village apparatus neutrality in the 2024 Bantul Regency Regional Head Elections (Pilkada). Bureaucratic neutrality at the village level is a fundamental pillar of democracy, but in practice it is often violated due to various socio-political pressures. This study aims to identify forms of neutrality violations, analyze their causes, and evaluate the effectiveness of law enforcement mechanisms implemented by the Bantul Regency Election Supervisory Agency (Bawaslu). The type of research used is empirical legal research. The nature of this research is descriptive and analytical, describing and analyzing cases. The analysis of this research uses a statutory approach and a case approach. The legal analysis used by the author is an inductive reasoning process. Data collection is conducted through interviews with Bawaslu and relevant village officials, as well as document studies of regulations and reports on the handling of violations. The case analysis consists of factors, forms of violations, and the mechanisms used by Bawaslu Bantul Regency to handle violations. The analysis will be conducted using a theoretical frameworks such as the Pancasila democracy theory, legal certainty, and law enforcement. The research results show three causal factors: kinship ties, political pressure and intervention, and clientelistic village interests. The three main forms of violations are: participation in public campaigns, campaigns through social media, and covert mobilization of support. Analysis of the law enforcement mechanism shows that Bawaslu has carried out the violation handling process in accordance with procedures. However, this mechanism has proven to be substantively ineffective because the authority to impose sanctions is limited to recommendations, with final sanctions being light (verbal/written warnings) and imposed by the direct superior of the violator (village head), thus failing to deter future violations. This study concludes that the existing legal framework has structural weaknesses in enforcement, resulting in symbolic law enforcement and failing to fully guarantee the neutrality of village officials.
