Abstract
The provision of holiday bonuses (BHR) to online motorcycle taxi (ojol) drivers is a new phenomenon in labor practices in Indonesia that raises various legal issues, particularly regarding the drivers’ status as business partners rather than employees. This study aims to analyze the legal framework regarding the provision of BHR to ojol drivers based on their partnership status and to examine the role and responsibilities of the government in responding to and addressing this issue. This is a field research study employing an empirical legal approach. The data analysis method used in this study is qualitative descriptive. For data collection techniques, the researcher employed literature review, observation, and interviews. The results indicate that regulations regarding BHR for ojol drivers lack an explicit, legally binding legal basis and remain in the form of government policy guidelines, such as circular letters from the Ministry of Manpower. In this regard, the government plays a strategic role as both a regulator and a supervisor; however, it has not yet been effective in providing legal certainty and comprehensive protection for ride-hailing drivers. Furthermore, the government’s responsibility should not be limited to issuing appeals but should also include establishing clearer and binding regulations, as well as supervising their implementation to ensure the protection of drivers’ economic rights. Therefore, concrete measures are needed from the government to reformulate labor policies that are adaptive to the development of the digital economy, in order to create a balance between the interests of platform companies and the protection of partner drivers.
