Abstract
Fear of marriage and expectations of an ideal marriage shaped by social media content have influenced individuals’ standards for choosing a spouse, which has become one of the factors contributing to the decline in marriage rates. A prenuptial agreement may serve as a solution for fulfilling individuals’ expectations of a spouse because it can reduce fears and accommodate expectations, provided that its provisions do not conflict with the law, religion, or public morality. A representation of this function of a prenuptial agreement can be found in the drama series Bidadari Bermata Bening, where a prenuptial agreement is used to fulfill an individual's religious standards regarding a spouse through a clause stipulating that no physical contact would occur before the husband had mastered Juz ‘Amma and Surah Yasin. This study aims to describe and explain the factors underlying the emergence of the prenuptial agreement in the drama series Bidadari Bermata Bening, to analyze it using Social Exchange Theory and Islamic Sociology of Law, and to examine its validity under Indonesian positive law. This research is a library research study employing social, juridical, and Islamic sociology of law approaches. The social analysis is conducted using George C. Homans’ Social Exchange Theory and the perspective of Islamic Sociology of Law, while the normative analysis is based on Law Number 1 of 1974 concerning Marriage, the Compilation of Islamic Law, and the Indonesian Civil Code. Data were collected through documentation of scenes and dialogues in the drama series, as well as through a literature review of written sources relevant to the research topic. The data were analyzed qualitatively using a deductive method and Miles and Huberman’s interactive analysis model, which consists of data reduction, data presentation, conclusion drawing, and verification. The findings indicate that the emergence of the prenuptial agreement was motivated by Ayna perception of Yoyok suitability as a husband. The factors influencing this perception include Ayna religious lifestyle, her mother’s messages and expectations, her experiences with gus Afif, Yoyok level of religious understanding, and a promise she made to her aunt. From the perspective of Islamic Sociology of Law, Ayna assessment of the ideal husband, her evaluation of Yoyok suitability, and her decision to marry despite not desiring the marriage were influenced by values embedded within Islamic law. These values determined what she considered valuable and, consequently, influenced her selection of rewards and costs within the framework of Social Exchange Theory. From a juridical perspective, the prenuptial agreement is legally invalid because it was made orally without authorization by a competent official, failed to satisfy the requirement of a specific object, and contained clauses that potentially diminished the rights and obligations arising from marriage.
