Abstract

The rapid growth of the global halal industry and the Indonesian government’s commitment to empowering Micro and Small Enterprises (MSEs) have led to the creation of a self-declaration halal certification scheme, as regulated by Decision of the Head of the Halal Product Guarantee Agency (Kepkaban) No. 146 of 2025. This scheme aims to simplify procedures and eliminate certification costs for MSME operators. However, its implementation in the Special Region of Yogyakarta still faces various obstacles, including low business operator participation, a lack of trust in facilitators, concerns about fraud, as well as technical and administrative constraints within the SIHALAL system. This study examines the dynamics of the policy’s implementation in the DIY region, particularly in Gunungkidul Regency, and reveals the gap between normative provisions and on-the-ground realities from the perspective of Islamic economic empowerment. This study is a field research project employing a descriptive-analytical, legal-empirical approach. Primary data was collected through in-depth interviews with Halal Product Process Facilitators (PPH) and MSME operators in the Special Region of Yogyakarta (DIY), while secondary data was sourced from legislation, academic literature, and official documents from the Indonesian Halal Product Certification Agency (BPJPH). The analysis was conducted using two main theoretical frameworks: Lawrence M. Friedman’s legal system theory, which encompasses legal structure, legal substance, and legal culture; and Jasser Auda’s system-based perspective on maqāṣid al-syarī‘ah, which includes six features: cognitive, holistic, openness, interrelated hierarchy, multidimensionality, and intentionality. The data was analyzed inductively to produce a deep understanding of the policy’s effectiveness. The research findings indicate that the implementation of Kepkaban No. 146 of 2025 regarding the self-declaration halal certification scheme in the Special Region of Yogyakarta has been only partially successful. Viewed from Lawrence M. Friedman’s legal system theory, this policy still faces obstacles in three main elements: legal culture (low trust and resistance among MSME actors), legal substance (suboptimal secondary regulations and information systems), and legal structure (high dependence on the role of PPH facilitators at the village level). Meanwhile, from the perspective of Jasser Auda’s maqāṣid al-syarī‘ah, this policy aligns with the six features of the system—cognitive, holistic, openness, interrelated hierarchy, multidimensionality, and purposefulness—and demonstrates policy adaptation efforts that support ease of access and the empowerment of SMEs. Thus, the self-declaration halal certification scheme has the potential to become an effective instrument of Islamic law, although it still requires strengthening of the three elements of the legal system to ensure its implementation is more optimal and sustainable.
