Abstract
This research is motivated by the problem of the quality of legislative members which is often associated with weaknesses in the recruitment mechanism of legislative candidates within political parties in Indonesia. In practice, the nomination process frequently prioritizes popularity, electability, and political capital rather than intellectual capacity, integrity, and cadre experience. This condition creates tension between the principle of equality of political rights for citizens and the need for legislators who possess the competence to perform legislative, oversight, and budgeting functions. This study aims to analyze how the principle of meritocracy can be understood within the context of administrative requirements for legislative candidates and how this principle can be integrated into the recruitment and cadre formation mechanisms of political parties without violating constitutional principles concerning the equality of political rights. This research employs a normative legal method using statutory, conceptual, and comparative approaches. Primary legal materials are derived from legislation related to elections and political parties, particularly Article 240 of Law Number 7 of 2017 on General Elections and the Political Parties Law. The analytical framework of this study draws upon the theory of meritocracy proposed by Michael Young, the theory of candidate selection developed by Reuven Hazan, and the perspective of Muhammad Iqbal regarding ethical leadership and moral integrity in political leadership. Legal materials were collected through library research involving academic literature, journals, books, and other relevant scholarly sources. The results of this study indicate that the existing administrative requirements in electoral regulations have not substantively reflected the principle of meritocracy. The main problem lies in the internal recruitment practices of political parties which tend to be pragmatic and prioritize popularity over competence. Therefore, strengthening the principle of merit should be institutionalized within the internal mechanisms of political parties through competency standards, systematic cadre development, and transparent candidate selection processes based on capacity. Such an approach does not contradict the principle of equality before the law because it does not restrict citizens’ political rights, but rather strengthens the role of political parties as democratic gatekeepers in producing legislative candidates who possess capacity, integrity, and constitutional responsibility.
