Abstract

Constitutional Court Decision Number 56/PUU-XVII/2019 reinstated the five-year waiting period requirement for former corruption convicts seeking to run as regional head candidates, after it had previously been abolished through Decision Number 42/PUU-XIII/2015. This shift merits examination, given empirical evidence showing continued recidivism among elected regional heads even after the requirement was removed. This study aims to analyze the existence of the Constitutional Court’s legal reasoning (ratio decidendi) in establishing the five-year waiting period, and to examine the decision from the perspective of siyasah qadha’iyyah. This research is a normative juridical study employing a case approach and a conceptual approach. It is descriptive-analytical in nature, with data collected through library research on primary, secondary, and tertiary legal materials, which were then analyzed descriptively. The findings reveal two main conclusions. First, the Constitutional Court’s ratio decidendi in Decision Number 56/PUU-XVII/2019 is firmly established and rests on three mutually reinforcing pillars: the conception of regional head office as a public trust requiring moral fitness, the restoration of legal reasoning following the empirical failure of the alternative requirement under Decision Number 42/PUU-XIII/2015, and the final and erga omnes binding force of the decision, which directly reshaped the regulatory landscape for regional head nominations. Second, viewed through the lens of siyasah qadha’iyyah, the Court’s legal reasoning aligns with the principle of al-amanah in public leadership, the realization of maqashid al-shari’ah through hifz al-ummah and hifz al-mal, and the qadha’iyyah function of preventing structural injustice. The five-year restriction on the right to be elected for former corruption convicts is therefore a proportional, legitimate, and necessary legal policy for strengthening substantive democracy in Indonesia.
