Abstract
This research is motivated by the use of omnichannel strategies by modern retailers, which has generated both pros and cons, particularly regarding the effectiveness of competition law, the dynamics of modern retail, and omnichannel integration policies, which are no longer viewed simply as business innovations. This study aims to analyze the potential market access barriers for traditional businesses in modern retail from the perspective of Law No. 5 of 1999 and the Maqāṣid al-Sharī'ah. This research is qualitative, employing a descriptive-analytical empirical juridical approach and a sociological approach. Data collection methods included interviews, observations of the features and services of modern retail applications in Indonesia, and documentation. Data analysis employed qualitative content analysis techniques. The results indicate that retail market share is above the dominant position threshold as defined by Article 25 paragraph 2 of Law No. 5 of 1999. This situation indicates the potential for abuse of a dominant position, reinforcing structural barriers in the form of disparities in capital, economies of scale, and technological mastery, significantly limiting market access for traditional businesses. According to the Maqāṣid al-Sharī'ah perspective Ibn Ashur, omnichannel integration concentrated on dominant players creates collective harm due to the creation of injustice and market distortion, even though the potential for partnerships still exists. This study concludes the need for stricter enforcement of competition law and the formulation of policies that focus on regulation, digital capacity, and the optimization of strategic partnerships to ensure the sustainability of traditional business actors.
