Abstract
Royalty rights are part of the economic rights attached to song creators and are protected under Law Number 28 of 2014 concerning Copyright. However, in practice, disputes frequently arise due to the commercial use of songs without prior permission and royalty payments to the creators. One of the prominent cases is the copyright dispute between Ari Bias and Agnez Mo, which was decided in Decision Number 92/Pdt.Sus-HKI/Cipta/2024/PN Niaga Jakarta Pusat. This case raises important legal issues regarding the protection of creators’ royalty rights, the responsibility of parties utilizing copyrighted songs for commercial purposes, and the realization of justice in judicial decisions. Therefore, this research aims to analyze the legal protection of royalty rights under Indonesian Copyright Law and to examine the aspect of justice reflected in the court’s decision. This study employs a normative legal research method using both the statute approach and the case approach. The primary legal materials consist of Law Number 28 of 2014 concerning Copyright, Government Regulation Number 56 of 2021 concerning the Management of Song and Music Royalties, and Decision Number 92/Pdt.Sus-HKI/Cipta/2024/PN Niaga Jakarta Pusat. Secondary legal materials include books, scientific journals, and other relevant legal literature. The collected legal materials were analyzed qualitatively using legal protection theory, legal certainty theory, and Gustav Radbruch’s theory of justice as analytical frameworks. The results of this study indicate that Indonesia’s copyright legal framework has normatively provided adequate protection for creators’ royalty rights through the recognition of economic rights, licensing requirements, royalty payment mechanisms, and legal enforcement measures. Furthermore, Decision Number 92/Pdt.Sus-HKI/Cipta/2024/PN Niaga Jakarta Pusat demonstrates legal protection for creators’ economic rights and reflects the consistent application of copyright law, thereby ensuring legal certainty. Nevertheless, from the perspective of substantive justice, the court’s reasoning has not comprehensively explained the basis for assigning liability and assessing proportional economic losses suffered by the creator. Consequently, the decision reflects a balance between legal certainty and justice, although it tends to emphasize legal certainty more strongly.
