Abstract
The maisi sasuduik tradition is one of the traditions still practiced in Minangkabau traditional weddings in Gurun Laweh Village, Nanggalo District, Padang City. This tradition is carried out through a deliberation process between both families to determine the form and amount of sasuduik according to their abilities and mutual agreement. Even though society is in the midst of modernization, the maisi sasuduik tradition is still maintained and considered an important part of Minangkabau wedding customs. This study aims to determine the community's views on the maisi sasuduik tradition in the modernization era, the reasons why people still maintain this tradition, and analyze the maisi sasuduik tradition from an Islamic legal perspective. This study is a field research using qualitative methods and a legal sociology approach. Data were obtained through interviews, observations, and documentation with ninik mamak, traditional leaders, community leaders, and members of the community who have been involved in the implementation of the maisi sasuduik tradition. Data were analyzed descriptively using George Homans' social exchange theory, Roger Fisher and William Ury's negotiation theory, and the theory of 'Urf Wahbah az-Zuhaili. The research results show that the people of Gurun Laweh Village still view the maisi sasuduik tradition as an important part of Minangkabau traditional marriage because it embodies the values of respect for women, responsibility, deliberation, and strengthening family ties. This tradition is still maintained because it is considered to have social benefits, strengthens family ties, and is part of the cultural identity of the Minangkabau people. The maisi sasuduik ceremony is carried out through deliberation and negotiation to reach an agreement acceptable to both parties. From an Islamic legal perspective, the maisi sasuduik tradition is considered authentic (urf sahih) because it has become a socially accepted custom, contains benefits, and does not conflict with Islamic law. This tradition is also not a requirement for a valid marriage, so it can be accepted and maintained as part of Minangkabau custom that aligns with Islamic values.
