Abstract

The right to adequate housing is a constitutional right guaranteed under Article 28H paragraph (1) of the 1945 Constitution of the Republic of Indonesia. Within the framework of the welfare state, the government is not only responsible for regulating public affairs but also has an active obligation to ensure the fulfillment of this right through the establishment of fair, legally certain, and welfare-oriented policies and legislation. Law Number 4 of 2016 concerning the Public Housing Savings Program TAPERA was enacted as a legal instrument to support sustainable and long-term housing financing. However, the provisions concerning participants obligations and the implementation of the TAPERA program, particularly those stipulated in Article 7, have raised concerns regarding the clarity of legal norms and the certainty of benefits provided to participants. Therefore, this study examines two principal issues: whether the regulation of TAPERA is consistent with the principle of legal certainty and realizing the principles of a welfare state in fulfilling the right to adequate housing. This research is a normative legal study employing a library research method. The approaches used in this study are the statute approach and the comparative approach. The primary legal materials consist of legislation related to housing and TAPERA, while the secondary legal materials include books, academic journals, scientific articles, and other relevant scholarly works. The collected legal materials are analyzed qualitatively using a deductive method to examine legal certainty in Article 7 of the TAPERA Law concerning the fulfillment of housing rights. The findings reveal that article 7 of Law Number 4 of 2016 has not fully guaranteed legal certainty in fulfilling the right to adequate housing for TAPERA participants. Fundamentally, TAPERA functions merely as a housing financing instrument; therefore, it does not directly ensure the fulfillment of adequate housing standards. Furthermore, participants’ obligation to contribute savings has not been accompanied by clear and measurable guarantees regarding housing benefits, access mechanisms, and legal protection for all participants. The existence of regulatory disharmony between the objective of fulfilling housing rights, the legal framework governing TAPERA, and the principles of the welfare state indicates that the current arrangement has not yet achieved optimal effectiveness. Consequently, a comprehensive evaluation and restructuring of TAPERA regulations are necessary to ensure their conformity with the mandate of the 1945 Constitution, the principle of legal certainty, and the broader goal of public welfare.
