Abstract

The phenomenon of Pintaan in the traditional marriage customs of Tanjung Seteko Village, Indralaya District, Ogan Ilir Regency, is a customary practice that continues to be preserved by the local community. Pintaan refers to a request made by the bride's parents to the prospective groom before the marriage ceremony takes place. In practice, Pintaan is regarded as a form of respect for the bride's family and a symbol of the groom's sincerity and responsibility. However, Pintaan is different from mahr (dowry). In Islamic law, mahr is a mandatory gift from the prospective husband to the prospective wife and constitutes one of the wife's rights in marriage, whereas Pintaan is a customary tradition that originates from local social practices and is neither a pillar nor a legal requirement for the validity of marriage. Nevertheless, the amount of Pintaan requested often gives rise to differing opinions within the community and is sometimes considered burdensome for the groom's family, potentially delaying or hindering marriage. Based on this phenomenon, this study addresses three main research questions: (1) how traditional leaders, religious leaders, and the general public perceive the Pintaan tradition; (2) how the tradition is analyzed through the perspective of Al-Ghazali's theory of Maṣlaḥah Mursalah; and (3) how the perspectives of these three groups compare. Accordingly, this study aims to examine community perspectives on the Pintaan tradition and to analyze it from the perspective of Maṣlaḥah Mursalah. This study is field research using a descriptive qualitative approach and an Usul Fikih approach. Primary data were obtained through interviews with traditional leaders, religious leaders, and community members in Tanjung Seteko Village, supported by observation and documentation. Secondary data were collected from books, journals, and literature related to marriage customs, Islamic law, and the theory of Maslahah Mursalah. The data analysis technique used was descriptive-analytical by describing the informants’ views and then analyzing them using Al-Ghazali’s theory of Maslahah Mursalah. The results of the study indicate that traditional leaders view the Pintaan tradition as a cultural heritage that should be preserved because it reflects respect and strengthens family relationships. Religious leaders argue that the tradition is permissible as long as it does not contradict Islamic law and does not burden the groom’s family. Meanwhile, the general public holds diverse views; some consider Pintaan a symbol of responsibility and appreciation for women, while others see excessively high Pintaan as an economic burden. Based on Al-Ghazali’s theory of Maslahah Mursalah, the Pintaan tradition is acceptable because it contains values of public benefit, such as maintaining social relationships and honoring women, as long as it is practiced reasonably and does not cause harm. Therefore, the Pintaan tradition can still be preserved as part of community customs as long as its implementation remains in harmony with the principles of public benefit and Islamic teachings.
