Abstract

The “anak oleh-oleh” phenomenon among migrant worker families in Lenek Lauk Village concerns the child’s legal status and social stigma related to parentage and family circumstances. This study analyzes the child’s status under Indonesian Islamic Family Law, the validity of the parents’ marriage, and identity-management strategies in facing stigma. Using field research with a qualitative, descriptive-analytical, and socio-legal approach, data were collected through interviews, observation, and documentation and analyzed using the Miles and Huberman model. The findings indicate that, under fiqh, the parents’ marriage cannot be established as valid due to insufficient evidence of essential requirements, particularly wali and witnesses. Through sadd al-dharī‘ah, the marriage is deemed bāṭil, affecting the child’s nasab, inheritance, and paternal guardianship. Under positive law, non-registration alone does not make a child born outside marriage; however, where the marriage’s validity cannot be established, the child’s status as legitimate cannot be determined. Socially, stigma arises from discrepancies between virtual and actual social identity, predominantly as tribal stigma in a discredited condition. The child manages stigma through covering, supported by the own and the wise.
