Abstract

This research is motivated by the persistent inequality in land control and utilization in Indonesia, while agrarian reform policies are intended to promote a more equitable arrangement of land tenure, ownership, use, and utilization and to ensure that land resources provide broader social benefits. From the perspective of Islamic law, the concept of iḥyā’ al-mawāt contains the principle of utilizing unproductive or uncultivated land so that it can generate benefits. The issue, however, is how this concept can be modernized and situated within the framework of the national agrarian legal system without applying classical fiqh provisions literally. This study aims to analyze and modernize the concept of iḥyā’ al-mawāt within the framework of agrarian reform, examine fiqh al-arḍ and the value of social justice as normative alternatives for addressing inequality in land control, and analyze the relationship between Islamic legal principles and national agrarian reform policies in realizing social justice and public welfare. This research employs a normative juridical method using statutory, conceptual, and Islamic legal approaches. Legal materials are analyzed qualitatively through the examination of the concepts of iḥyā’ al-mawāt, fiqh al-arḍ, the principles of justice and public welfare, and the national agrarian legal framework, particularly agrarian reform policies. The findings indicate that the concept of iḥyā’ al-mawāt can be modernized by transforming its substantive values into the national agrarian legal system. This modernization is formulated through six principles: land productivity, prevention of land abandonment, the social function of land rights, state supervision, land redistribution, and distributive justice. These principles constitute the Modernization Model of Iḥyā’ al-Mawāt Based on National Agrarian Reform, which does not replace the national agrarian legal system but provides a normative framework for strengthening the orientation of land governance toward productivity, social justice, and public welfare. The study of fiqh al-arḍ demonstrates that land is not merely an object of individual ownership but also entails a social responsibility in its utilization. The value of social justice embodied in iḥyā’ al-mawāt can serve as a normative alternative for expanding access to agrarian resources and addressing inequality in land control. The relationship between Islamic legal principles and agrarian reform lies in the transformation of substantive Islamic legal values into instruments of modern agrarian law and policy. Thus, iḥyā’ al-mawāt, fiqh al-arḍ, and agrarian reform policies share a common orientation toward productive and equitable land utilization based on public welfare.
