Abstract

The community of Tapporang Village has developed a cooperative ar-rangement for managing clove plantations that differs from conventional profit-sharing systems. Under this practice, the landowner entrusts vacant land to a tenant farmer to plant clove seedlings. Once the plants reach approximately three years of age or begin to bear fruit, the land and the plants growing on it are divided equally between the landowner and the tenant farmer. This land-sharing practice takes place amid a regulatory gap, as Law Number 2 of 1960 concerning Sharecropping Agreements regulates the periodic distribution of ag-ricultural yields rather than the division of land and the plants growing on it. This situation raises legal issues concerning the validity of the agreement, the extent to which the principle of justice is fulfilled for both parties, particularly the tenant farmer who bears all cultivation and maintenance costs and risks without a guaranteed livelihood, and the legal consequences arising from the implementation of the agreement. This research employs an empirical legal research method using statu-tory and conceptual approaches. Primary data were obtained through inter-views and observations, while secondary data were collected from primary, sec-ondary, and tertiary legal materials through library research. The collected data were analyzed using a qualitative-descriptive method, drawing on contract law theory and ‘Aqd al-Mughārasah to examine the validity of the agreement, John Rawls’s theory of justice to assess the fulfillment of the principle of justice, and al-Shāṭibī’s theory of Maqāṣid al-Sharī‘ah to analyze the legal consequences of the agreement’s implementation. The findings indicate that the land-sharing agreement for clove planta-tions in Tapporang Village is valid and binding upon the parties; however, the transfer of land ownership rights has not been formally perfected. Based on John Rawls’s theory of justice, the agreement is relatively fair when imple-mented to completion, but it does not fully protect tenant farmers against the risks of loss and unilateral termination. Meanwhile, from the perspective of Maqāṣid al-Sharī‘ah, this practice provides public benefits through the produc-tive utilization of land. Nevertheless, stronger protection is needed to safeguard the economic interests and livelihood sustainability of tenant farmers.
