Abstract

The fundamental problem of Islamic jurisprudence (usul al-fiqh) is its focus of attention which tends to emphasize a law in book than law in action. In history, the crisis of method caused to conflict and tension between theory and practice of Islamic law. Nowadays, it is needed to formulate precise method to eliminate both of them. The paper discuses Louay Safi’s thought in the case of a univied approach to syari’ah and social inference. Base on this idea, Safi tries to reconcile simultanly between textual (normatif) and contextual (historical) approach in endeover to Islamic law discovery. According to writer, the thought is more promised to be developed as alternative method of contemparary istinbat (Ijtihad), because of its operasionble caracter will enable to discover or produce a sui generis–cumempirical caracter of Islamic law.
