Abstract

Bantul Regional Regulation Number 21 of 2018 concerning the Implementation of People's Markets, Supermarkets and Shopping Centers. Chapter 36 stipulates that the distance for the establishment of supermarkets in the form of mini-markets, supermarkets, department stores that are networked and franchised may only be established at the closest distance of three km from the traditional market. Meanwhile, supermarkets that are not networked and are not franchised may be established as close as 0.5 km from the traditional market. The problem is the relatively close market distance between traditional markets and other traditional markets which has resulted in many networked and non-networked supermarkets appearing without permits based on Perda number 21 of 2018. This research focuses on how these regulations can be implemented in Bantul Regency. Is the public policy in accordance with the objectives of the formation of the above regulation. And how is the role of local government in controlling and facilitating the regulation. What are the constraint factors? The research method being used is field research, analytical descriptive, juridical empirical based on the law approach, data collection techniques using observation, interviews, and documentation. This research is based on the prevailing public policy and regional autonomy which regulates the arrangement of the establishment of supermarkets related to the existence of traditional markets in each sub-district. The results of the study conclude that Regional Regulation Number 21 of 2018 chapter 36 has not been implemented properly, because first, the distribution between supermarkets and traditional markets in Bantul is not balanced. Second, the existence of supermarkets continues to increase every year, there are 161 supermarkets with uneven distribution tending to cluster in the northern part of Bantul Regency, while traditional markets are spread over 17 sub-districts. Third, it was found that several supermarkets violated the regulation, such as: licenses that were not fulfilled or expired and the distance of the convenience store was too close to traditional markets. Fourth, there was no firm sanction for violating the regulation. For example, there are 32 supermarkets adjacent to 17 traditional markets, the sanctions are only limited to giving warnings, no one has received a revocation of a supermarket business license or business closure. The control in this thesis refers to the distance rules of establishment contained in Perda number 21 of 2018. The control of the distance for the establishment of supermarkets is a government policy effort in maintaining the balance of the economy of the modern sector and the traditional sector to remain competitive. However, the good values contained in this regional regulation do not necessarily work if it’s not in harmony with law enforcement officials, the community, and the legal culture system in it. So that the limitation of supermarkets must go hand in hand with improving the quality of traditional markets.
