Abstract

Indonesia has regulations governing mental health which are compiled in the form of Law no. 18 of 2014 concerning Mental Health. This law was established to ensure that everyone lives in physical and spiritual prosperity and obtains health services as mandated by the 1945 Constitution of the Indonesian Republic. mental health services. Therefore, further studies are needed through siyãsah idãriyah, and guarantees of Human Rights (HAM). In conducting this research, the authors used the type of library research, with the nature of descriptive analysis research. The approach in this study uses a normative approach. Sources of data used in the form of primary data sources in the form of Law no. 18 of 2014 concerning Mental Health and also secondary data sources in the form of books, journals, publications, and previous research as well as data related to this research. In general, the theory used in this study is the theory of siyãsah idãriyah to analyze mental health services in Law no. 18 of 2014 concerning Mental Health, as well as the view of Human Rights in fulfilling the right to health services for People with Mental Disorders (ODGJ). The results of this study, first, Law no. 18 of 2014 concerning Mental Health has been in accordance with the theory of siyãsah idãriyah, however, the implementation of this law is still considered less than optimal. Second, the protection of the right to health services for ODGJ has been regulated in Law no. 18 of 2014 concerning Mental Health. This right is in the form of health services in health facilities, obtaining mental health services that are provided comprehensively and continuously, receiving treatment from health workers who have competence in the field of mental health and obtaining mental health supplies.
