Abstract

In Law Number 1 of 1974 concerning marriage in Indonesia it is stated that, marriage is an inner and outer bond between a man and a woman as husband and wife with the aim of forming a happy and eternal family based on the One Godhead. The purpose of marriage is to fulfill the basic biological need for reproduction. Islam pays attention to the availability of a healthy and comfortable environment for raising offspring. The majority of married couples expect the presence of their baby, but there are some couples who do not want children, or what is more popular today is known as childfree. A new phenomenon that is currently being discussed, namely childfree or in other terms "free from children", does not only occur in western society, now it has spread to the body of Muslims, including the two sources from Kupang City who decided to be childfree. Not a few who support, invite to do so, and distribute it without validation and confirmation. Seeing this phenomenon, the focuses of this research is; First, why do couples choose to be childfree. second, how is the relationship between husband and wife who decides to be childfree in building domestic harmony. Third, what is the perspective of maslahah mursalah regarding childfreedom and household harmony. The theory used in this study is the theory of maslahah mursalah with the type of field research using a qualitative descriptive approach. The results of the study were found several factors or reasons why husband and wife decided to do childfree. First, because they want to spend time and are free to do any activity only with their partner. Second, feeling afraid of failing to become a parent, thinking about the child's psyche in the future and the unpleasant childhood trauma. As for the harmony in the household for husband and wife couples who decide to be childfree, they state that a harmonious family is a family that is able to build a good family, between husband and wife are able to work together, accept and complement each other's shortcomings, and how how to treat your partner well so that the household that is run will always be peaceful, peaceful and happy. Judging from the maqashid syariah theory about child-free and harmony in the household if it is oriented as the goal of maslahah put forward by al-Ghazali, that a married couple who decides to be child-free do not reach the degree of maslahah because their reason for doing child-free does not achieve the goals of Islamic law which in this case is hifz al nasl (keeping offspring).
