Abstract

Copyright is one of the intellectual works that is an important part of Intellectual Property Rights. Copyright is an exclusive right for creators or rights holders to publish or reproduce their creations that arise automatically after a creation is born without reducing restrictions according to applicable laws and regulations. The importance of Copyright issues, prompted the promulgation of Government Pegulation Number 56 of 2021 concerning the Management of Song and/or Music Copyright Royalties. One of the works included in the scope of Copyright is the Hymn of UIN Sunan Kalijaga Yogyakarta. From the search results on the official website of the Directorate General of Intellectual Property, namely the Intellectual Property Database, the Copyright for the Hymn of UIN Sunan Kalijaga Yogyakarta has not been registered with its ownership rights. This is important to note because the UIN Sunan Kalijaga Hymn is often used and sung in formal and non-formal events both on campus and outside campus. This study analyzes the implementation of Government Regulation Number 56 of 2021 in guaranteeing legal certainty for song and/music copyright holders as well as legal remedies that can be taken in order to obtain rights for copyright holders of the Hymns of UIN Sunan Kalijaga Yogyakarta. This research is a field research and library research with a normative juridical approach. The nature of this research is analytical descriptive to describe, describe, and analyze legal certainty and rights for copyright holders of songs and/or music for Hymns at UIN Sunan Kalijaga Yogyakarta by using the framework of legal certainty theory, copyright theory, and basic music theory. Data collection techniques in this study used field studies and literature studies. Field studies include observation and interview activities. Literature studies in the form of literature books, journals, theses, theses, and laws and regulations. The results of the study show that the copyright holder for the UIN Sunan Kalijaga Hymn is UIN Sunan Kalijaga based on Article 1 paragraph (6) of Government Regulation Number 56 of 2021. Legal certainty guarantees economic rights in the form of royalties in Government Regulation Number 56 of 2021 concerning Management of Copyright Royalties The implementation of songs and/or music cannot be carried out optimally because UIN Sunan Kalijaga Yogyakarta as the copyright holder has not registered their ownership rights. Copyright restrictions on UIN Sunan Kalijaga Hymns are regulated in Article 43 letter (d) of Law Number 28 of 2014 concerning Copyright in relation to the creation and dissemination of Hymn content for UIN Syarif Hidayatullah Jakarta and UIN Sunan Gunung Djati Bandung which have similarities with UIN Sunan Kalijaga Hymns is not considered a copyright infringement because it is not commercial (for profit).
