Abstract

Humans are social beings who depend on each other. So humans need other humans to be able to continue the next life. Humans are created in pairs. In establishing a relationship in pairs in Islam, it will go through marriage, and marriage is one of the goals in life. In the view of Islam, marriage is a very strong bond or contract in terms of inner and outer ties. Talking about finding a life partner, of course we see and see first how our partner starts from face to toe. What if people with disabilities who can't see then do other activities such as cooking, sweeping, washing and so on, of course with things like that seeing is the main solution in doing it all. This research is a type of field research, with data collection methods from interviews, and documentation. This study uses a descriptive analysis approach that aims to explain how the lives of families with disabilities in Kotagede Yogyakarta, and how the views of positive law and Islamic law on the fulfillment of the rights and obligations of husband and wife with visual impairments. The conclusions in this study indicate that husband and wife with disabilities can carry out their rights and obligations. The husband's obligations include providing a living, shelter, education and affection. This is if it is reviewed through positive law according to article 80 of the KHI. Meanwhile, if it is reviewed through Islamic law according to the content of the Qur'an surah al-Baqarah (2) : 233. The wife's obligation is to be obedient and devoted to her husband. This is if it is reviewed through positive law in accordance with Article 83 of the KHI. Meanwhile, if it is reviewed through Islamic law, it is in accordance with the content of the Qur'an Surah an-Nisa (4): 34.
