Abstract

The local government's authority in regulating and managing its own household is the authority to stipulate regional regulations. In forming regional regulations, formal and material requirements must be met. The stages of forming a regional regulation include the stages of planning, drafting, discussing, ratifying or stipulating and enacting. This is clearly stated in Law Number 12 of 2011 concerning the Formation of Legislation. In this study, the object of research was the Regional Regulation of Brebes Regency Number 1 of 2015 concerning Public Peace and Order. From this, the formulation of the problem arises: What is the juridical review of the technical preparation of the Brebes Regency Regional Regulation Number 1 of 2015 concerning Public Peace and Order according to the provisions of Law Number 12 of 2011 concerning the Formation of Legislation? What is Siyasah Tasyri'iyyah of the process of establishing the Regional Regulation of Brebes Regency Number 1 of 2015 concerning Public Peace and Order? This research uses normative research with library research, in which the researcher conducts a study of various literature and sources related to this research. To obtain valid data in this study, researchers used observation, documentation and interview methods. This research method is in the form of a juridical approach which is then analyzed using normative methods so as to obtain an analysis of the formulation of the problems found in the field. From the results of the study it was found that the construction of the Regional Regulation of Brebes Regency Number 1 of 2015 concerning Public Peace and Order was contrary to the technique of drafting statutory regulations. One of the problems or errors contained in the preparation technique is the consideration of remembering. In consideration given that the legal basis is not clear in the mention of the legal basis and in Brebes Regional Regulation No. 1 of 2015, the researcher is of the opinion that the regional regulation is a copy paste of another regional regulation.
