Abstract

In Indonesia the adoption of children has been regulated according to Law Number 23 of 2002 and the following regulations such as Government Regulation Number 54 of 2007 concerning Implementation of Child Adoption (PP Adoption) and Minister of Social Affairs Regulation Number 110 of 2009. Prospective Foster Parents (COTA) must follow the process and adoption procedures as per the regulation. In reality, many cases of adoption violate existing rules. Using qualitative research, this paper attempted to describe and explore the practice of adoption in the city of Yogyakarta and the role of social workers in the practice. The results of the study showed that there were several issues that arouse such as the legal dualism between the district court and the religious court, administrative problems and religious differences between COTA and children. Research also showed that social workers played administrative roles, advocates and mediators. Local governments should make regional regulations that determine where the adoption process is tried so that legal dualism does not occur, while social workers need to be more thorough and active in assisting the adoption process.
