Abstract

This study discusses the effectiveness of the supervisory role of the Syari'ah Supervisory Board at 5 Syari'ah Microfinance Institutions in East Lampung Regency, namely, at BMT Assyafi'iyyah Berkah Nasional, BMT Al-Fath Berkah Bersama, BPRS BAS (Bank Aman Syari'ah ), BMT Bina Insani, and BMT Ar-Rahmah Jaya Mulia. This research focuses on the actual role of the Syari'ah Supervisory Board in carrying out its duties to oversee the Syari'ah Microfinance Institution in East Lampung so that the contracts implemented are in accordance with the fatwas from the DSN-MUI. This research answers two problems, what is the working mechanism of the Syari'ah Supervisory Board (DPS) in supervising the implementation of Syari'ah Cooperatives in East Lampung Regency? How is the effectiveness of the supervisory performance of the Sharia Supervisory Board (DPS) in an effort to ensure shari'ah compliance in the Syari'ah Cooperative in East Lampung Regency? This type of research is field research, using a qualitative research methodology, with a normative juridical approach, while the data analysis method is descriptive analytic. In the data collection method, the authors use the method of observation, interviews, and documentation. The results showed that the supervisory role of the Syari'ah Supervisory Board in the Syari'ah Microfinance Institutions in East Lampung Regency was not fully effective and in accordance with the fatwa from the DSN-MUI, namely carrying out operational analysis, carrying out evaluations of activities and products from LKMS, ensuring that LKMS operational activities is in accordance with the fatwas stipulated by the National Syari'ah Council, provides opinions from shari'ah aspects on the implementation of bank operations and products issued as a whole in the LKMS publication report, analyzes new products and services for which there are no fatwas and then proposes a fatwa to the National Syari'ah Council, and submit reports on the results of shari'ah supervision at least once every six months to the directors, commissioners, the National Syari'ah Council and Bank Indonesia.
