Abstract

Islam does not prescribe the method by which a marriage should be performed. Everything is returned to the customs that take place in the area concerned. Islam only provides restrictions on things that are not allowed when carrying out a marriage ceremony and provides some recommendations in it. Before proceeding to the level of marriage the prospective groom in the Hampalit Community must give jujuran money to the prospective bride. Jujuran is a gift from the male party to the female party, in the form of a sum of money whose amount is determined by the female party. The jujuran nominal is usually in accordance with the social status of the prospective wife and her parents in terms of position, occupation, beauty and education level of the prospective wife. If the higher the social status of the prospective wife, the greater the value of the jujuran money that must be provided by the prospective husband. Analyzing the problem of the jujuran tradition, the researcher focuses on two main problems, namely the reason for the persistence of the jujuran tradition and the meaning of jujuran in marriage for the Hampalit village community. Researchers dissect this problem using the theory of legal sociology from Soejono Soekanto and several supporting theories such as Sociology of Islamic law, symbolic anthropology, Receptio a Concantario, Social Identity, Ta'awun to analyze the reasons for the existence and meanings of the jujuran tradition. This research also uses a descriptive-analytic type of field research with a legal sociology approach to understand and dive into the basic thoughts that live in society. This approach is useful for assessing the extent to which the process of mutual influence (reciprocity) between the social system and the legal system. The results of this study indicate that the jujuran tradition is still valid today as an obligation to preserve and uphold customs that have been carried out for generations and as a sign of seriousness and male responsibility. Furthermore, the meaning contained in this jujuran is first, as an identity of male struggle. The Hampalit Village community considers this jujuran tradition to be a portrait of the identity of a struggle that has been indoctrinated for generations which is indirectly formed internally in every man. In line with Erikson's explanation of self-identity. Second, a form of respect for women. Jujuran is a symbol of respect, because having a daughter for the Hampalit Village community is something that is highly guarded and highly protected by its honor, in line with the concept of muasyarah bil ma'ruf in the perspective of mubadalah.
