Abstract

The participation and role of women in political parties is still a hot debate among the public to this day. The majority of people think that women do not have the right to participate and have a political role in Indonesia. This is evidenced by the absence of an adequate system for women's political participation. Several views of positive law experts and Islamic law regarding women who participate and play a role in the world of politics raise pros and cons from various perspectives. The difference in perspective is what makes the researcher interested in researching this research. Some of the problem formulations obtained include how the positive legal perspective is on women who participate and play a role in the world of politics and how the perspective of Islamic law is on women who participate and play a role in the world of politics. This writer uses library research (Library Research). This research is carried out by citing several sources and studying the theories of experts and books related to the object to be studied, this refers to secondary data sources. The type of research used is a normative type carried out with secondary data to find out and analyze applicable law in Indonesia and Islamic law regarding women's participation in law enforcement agencies so that it is very relevant and has a correlation with the problems studied. The author uses the participation theory put forward by Suparjan and Hempri Suyatno. The role of politics places more emphasis on the position and duties that a person carries in politics, while political participation focuses on the way a person is involved and interacts with the political process itself. Role is the expected behavior of individuals in social institutions. Here the meaning of society is like a stage and individuals are like actors in society where they have to play different roles in different social institutions. In Islamic law, women's involvement in politics is regulated based on the interpretation and implementation of sharia or Islamic law in a country. The political role of women in Islamic law can vary depending on the country and how Islamic teachings are implemented.
