Abstract

In social life, buying and selling is often carried out to obtain convenience, without knowing whether the buying and selling is in accordance with the concept of Islamic law or even contradicts it. As practiced by the people of Purwodadi District, Purworejo Regency, they trade rice in bonded terms. Ijon is a sale and purchase that is prohibited because it contains an element of uncertainty (gharar), something that is speculative, or vague. This kind of transaction is unlawful to do, because it can harm one of the contracted parties, both the seller and the buyer. However, in the reality of everyday life there are still many farmers and buyers in Purwodadi District who still carry out rice buying and selling transactions in bonded terms. Departing from this phenomenon, the author is interested in examining more deeply the sociological review of Islamic law on the sale and purchase of rice using the bonded bond system that occurs in the people of Purwodadi District, Purworejo Regency. The reasons for the practice of buying and selling rice using the ijon system are still being carried out and what is the sociological review of Islamic law on the buying and selling of rice using the ijon system that occurs in the people of Purwodadi District, Purworejo Regency.This type of research is field research. By using a qualitative research method with a descriptive form of analysis as a knife analysis using the theory of legal sociology review and theory of social facts. The methods used in collecting primary data are observation, interviews, and documentation, as well as secondary data obtained from library materials in the form of books, journals, articles and so on. The results of this study indicate that the sale and purchase of rice under the ijon system carried out by the people of Purwodadi District, Purworejo Regency, is viewed in a Shari'ah way, which is not permissible. The absence of measurements in weighing and rice that is not ready for harvest indicates uncertainty in buying and selling rice with the ijon system. The sale and purchase of rice with the ijon system includes gharar yasir because in practice this sale and purchase fulfills the needs of each party, where farmers have a desire to meet their daily needs and buyers have a desire to fulfill their business continuity. Viewed from the people of Purwodadi District who always buys and sells rice using the bonded bond system continuously and has even become his habit, therefore in terms of the sociology of Islamic law there are several factors behind the sale and purchase of rice under the bonded system. Habitual factors and economic factors that cause the practice of buying and selling rice with the bonded bond system are still being carried out. The social facts that emerge in the community make them have no other choice to carry out the practice of buying and selling rice using the bonded bond system. This buying and selling has become a habit that is detrimental and attracts good fortune.
