Abstract

The practice of nganyareh kabin is a community tradition in Curah Kalong Village, Bangsalsari Kec. Jember Kab. The factor of doing so is due to frequent problems and arguments. The goal is to make the family better and more harmonious, fortune and be careful. The practice of nganayreh kabin carried out by the community is a tradition carried out by married couples whose marriages have been said to be legal according to religion and the state, and the practice is carried out not also because of the occurrence of a divorce, it's just that this practice is carried out by the community because in the family there are often problems and arguments that result in disharmony in the family, and also the practice of nganyareh kabin is done not only once or twice but is done repeatedly. Thus, the researcher conducted a study on the people who practice nganyareh kabin in order to find out the practice of nganyareh kabin carried out by the people in Curah Kalong Village and the implementation of Maqāṣid al-Usrah on the practice of nganyareh kabin in the lives of people in Curah Kalong Village. The type of research used is field research with an empirical normative approach and the nature of the research is qualitative, which explains the results of the research described from interviews with people who practice nganyareh kabin and religious leaders who also participate in the practice of nganyareh kabin and then analyzed using the maqāṣid al-usrah theory initiated by Jamāl ad-Dīn 'Aṭiyah. The result of the research is that the practice of nganyareh kabin carried out by the community in Curah Kalong Village, Bangsalsari District. Jember is a alternative that is not prohibited from the view of scholars, because the practice of nganyareh kabin carried out by the community has clear reasons and objectives, so this practice is permissible and is classified as maslaḥah ḥajjiyah, because people carry out the practice of nganyareh kabin in order to make their families better and more harmonious after frequent problems and arguments, so this practice is in accordance with Jamāl ad-Dīn 'Atṭiyah's Maqāṣid. The Maqāṣid of Jamāl ad-Dīn 'Atṭiyah is in accordance with the Maqāṣid of Jamāl ad-Dīn 'Atṭiyah, namely,.....
