Abstract

During the transition period of the 2024 simultaneous regional head elections, there were 101 regional heads with expired terms of office ending in 2022, 170 regional heads with expired terms of office ending in 2023, and also new regional heads who took office in 2020. Therefore, there is a policy to appoint acting regional heads as a form of government response so that the wheels of government in the regions continue to run. However, there are often pros and cons due to mechanisms that have the potential to cause new problems that will disrupt the administration of government in the regions in the future. Problems that arise due to the existence of a ministerial circular that distorts the authority of the acting regional head to mutate the state civil apparatus, namely with the issuance of Circular Letter of the Minister of Home Affairs Number 821/5492/SJ containing ministerial approval that acting, acting, and temporary acting to dismiss, temporarily dismiss, impose sanctions and approve employee mutations. This research uses normative juridical research methods by examining various sources of existing legal documents to obtain legal materials that can support and be accounted for. The nature of this research is descriptive-analytical research. The approaches used are statutory approach, analytical approach, and conceptual approach. This research is analyzed using the theory of authority and the theory of siyasah dusturiyah. The results of the research found that the Minister of Home Affairs exceeded his authority in the Circular Letter of the Minister of Home Affairs Number 821/5492/SJ. The authority exceeded is strategic actions that have an impact on personnel aspects. The principle of not abusing authority has been violated because materially the circular letter will cause a civil effect by exceeding its authority in the aspect of employment. The matter of exceeding the authority indicates that it is contrary to the General Principles of Good Governance. Therefore, the use of discretion that is contrary to the General Principles of Government is categorized as mixing up authority. When viewed through siyasah dusturiyah, the Circular Letter of the Minister of Home Affairs Number 821/5492/SJ is not appropriate. This is because the contents of the Circular of the Minister of Home Affairs Number 821/5492/SJ have implications for arbitrary actions by the authorities which will cause harm.
