Abstract

The Regional Representative Council is an institution that represents every region in Indonesia. The DPD is in the second chamber in the bicameral system implemented in Indonesia, but the bicameral system implemented in Indonesia has not fully implemented checks and balances between the first chamber and the second chamber. In discussing the revision of Law Number 17 of 2014 concerning the People's Consultative Assembly, the People's Representative Council, the Regional Representative Council and the Regional People's Representative Council DPD were not involved in either Level I or Level II discussions. In fact, provisions regarding DPD participation in discussing the revision of Law No. 17 of 2014 concerning MD3 already exist, especially in Constitutional Court Decision No. 92/PUU-X/2012, namely that the DPD must participate in discussing and drafting laws in accordance with its authority and duties. However, after the Constitutional Court's decision came out, the DPD was not included in Level I or Level II discussions regarding discussions on the revision of the Law. This research uses normative legal research by examining existing sources of legal documents to obtain legal materials that can be accounted for in this research, such as books, journals, articles, regulations and other scientific works. This research approach uses a regulatory-legislative approach, a contextual approach, and a comparative approach. This research is explained using the bicameral system theory and the concept of siyasah dusturiyah. The results of the research in this writing are that the DPD did not participate in the discussion of the revision of Law Number 17 of 2014 concerning the MPR, DPR, DPD and DPRD, because it was proven that in the minutes of the session the DPD did not participate in Level I Discussions which should have been Level I Discussions. This involved the DPD, then at Level II Discussions the National Legislative Body reported that the DPD sent a letter containing an opinion that several articles in Law no. 17 of 2014 was amended. In the results of this research, Indonesia has not yet fully implemented checks and balances in the bicameral system because the authority given to the DPD is very limited. If seen from the siyasah dusturiyah, the authority of the DPD cannot be equated with the authority of Ahl al-Hall Wall al-Aqd because the authority given to this institution is very broad.
