Abstract
Chemical castration is a criminal sanction in cases of sexual violence against children. It has always been a topic of discussion for years among the general public and intellectual groups, but in contrast, its implementation to date is very minimal compared to many cases of sexual violence against children. Children who should be looked after and guaranteed by all elements of their lives, become an anomaly when the child also becomes a victim of perpetrators of sexual violence. Cases of sexual violence against children in Indonesia are on the very worrying case index, it is suspected that there are still many cases that are not yet known. So it is interesting to examine the legal position in Indonesia and see its application. The author in this research used library research, namely researching written sources such as laws, decision files or books related to the research. The nature used is descriptive-analytical, the author tries to describe the data then carries out analysis. The approach used is normative juridical, carried out by reviewing statutory regulations. library data collection techniques. The author uses the theory of criminal responsibility and feels able to answer the position of chemical castration sanctions. The second theory used is legal protection to determine the level of urgency in implementing chemical castration sanctions. Chemical castration sanctions against perpetrators of criminal acts of sexual violence against children have the position of objective responsibility that can be imposed on perpetrators who fulfill the elements of breaking the law, while the subjective responsibility of the perpetrator must be intentional, and the urgency of implementing chemical castration sanctions against perpetrators of sexual violence in Indonesia is still concluded in a preventive manner. becomes urgent because it is needed to handle or prevent sexual violence against children. Meanwhile, repression is still widely doubted, because chemical castration could only be an agenda for retaliation without stopping or minimizing the number of cases that occur.
