Abstract

The most widely used social media as a means of buying and selling goods and services are Facebook and Instagram. Through Facebook and Instagram, daily necessities such as cosmetics and other equipment will be easily obtained. There are cosmetics on the market with various types of brands. The large number of consumer demands for cosmetics is exploited by irresponsible business actors by producing or trading cosmetics that do not meet the requirements for circulation to the public. Furthermore, the problems studied in this study are: a comparison of the validity of the sale and purchase agreement of cosmetics through the Facebook and Instagram applications according to the Civil Code, the legal consequences if one party defaults in the cosmetic sale and purchase agreement through the Facebook and Instagram applications, and legal protection for consumers in the agreement. buying and selling cosmetics through the Facebook and Instagram applications. To answer the problems above, the researcher uses a type of field research using an empirical juridical approach. The data collection method used is using the interview method and literature study. This research is descriptive qualitative, namely research that uses data sources that have been collected which are closely related to research, to then be analyzed and described from the data obtained. In this problem, the researcher uses the theory of legal responibility, theory of legal protection, and theory of legal certainty. From the results of research conducted by researchers, namely the validity of online cosmetic sales and purchase agreements through Facebook and Instagram, some agreements tend to still not meet the legal requirements based on the provisions of Article 1320 of the Civil Code. In the event of a default, the online seller/business actor is obliged to provide compensation, compensation, and replacement due to the goods or services received not in accordance with the wishes of the consumer. Legal protection for consumers in buying and selling cosmetics through Facebook and Instagram is regulated in the Consumer Protection Act, which in the Act regulates the rights that must be fulfilled by business actors in conducting online transactions so that there are no losses and irregularities. Good faith is also very important in this case so that the parties in the agreement have an obligation not to do things that are detrimental to one of the parties.
