Abstract

The claw game is one of the selling trends that has started to go viral on TikTok's live streaming content since the existence of the TikTokShop. The trading mechanism with the claw game system has two different versions. When selling with this claw game system, the seller will live stream at a certain time and create a special shopping cart for buyers to order the claw game product. After the buyer places an order, the seller will pick up the goods at random using tongs or other tools to pick up the items in the large container. The capitan results will be sent to the buyer. The mechanism of buying and selling like this allegedly contains gharar in it. The difference between the first and second versions lies in the goods obtained, in the second version, the products obtained can be exchanged according to the buyer's wishes with the seller's approval. Various consumer motives in making a purchase certainly have a specific purpose. The purpose of this consumption behavior is of course to achieve happiness, but in the sharia economy all actions must aim based on the provisions of Islamic law. This study aims to find out three things, namely: First, what is the mechanism for buying and selling game claw products in the TikTok application; second, what are the consumers' motives for buying game claw products; and third, How is the application of the sale and purchase contract in the implementation of the product clamp game in the TikTok application according to Islamic law. This type of research is field research with a normative research approach to Islamic law. The primary data is data obtained through observation, interviews and documentation. The secondary data is various literature that is relevant to this research. The results of the study show that based on the explanation regarding the mechanism of buying and selling with the claw game system that has been described above, if examined in a review of the buying and selling contract in Islamic law it can be concluded that the buying and selling of the first version of the claw game is prohibited while the second version of the buying and selling mechanism of the claw game is permitted. because the pillars and conditions of sale and purchase have been fulfilled. Even though there is one condition that is not fulfilled perfectly, namely the existence of gharar on the quantity or number of products/goods that consumers will receive, the gharar is included in gharar al-yasir, namely mild gharar which can be forgiven because this sale and purchase does not cause much dispute in the community. between the two parties in the contract so that its existence can be accepted. In addition, if it is reviewed again regarding consumer motives in purchasing this product claw game, not all trading like this is prohibited. Because there are reasons for consumers to make purchases that are limited to mere entertainment, not merely making a sale and purchase contract for certain products. So buying and selling like this is permissible. Because there are intentions other than buying and selling which affect the law of buying and selling.
