Abstract

The development of science and technology has created a new crime called cyber crime. One of the crimes that have emerged in the internet world is online gambling. With the emergence of internet technology, gambling is increasingly widespread and widely played by the community. In addition, the large number of dissemination of information containing gambling through promotions carried out by an influencer is also one of the factors that gambling increasingly exists in society. Therefore, Article 45 paragraph (2) in conjunction with Article 27 paragraph (2) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions was established to eradicate the activity of disseminating information containing gambling. However, law enforcement by the police against the dissemination of gambling information is still considered less than optimal seeing that gambling content is still rampant on social media. It was recorded that throughout 2022 the Ministry of Communication and Information has detected and blocked 156,975 online gambling content on various social media. For this reason, the authors are interested in examining law enforcement against influencers who promote online gambling sites through social media. This research is a type of field research with a juridical-empirical approach. The data collection techniques in this research are through observation and interviews. The analysis method used is qualitative analysis method by analyzing and describing the data obtained in the field and associated with the legislation. The results of this study are that law enforcement efforts by the DIY Police against influencers who promote online gambling sites through social media are carried out through 2 (two) steps, namely, preventive efforts and repressive efforts. Preventive efforts are carried out by conducting community education activities through socialization and appeals in the community and social media. Meanwhile, repressive efforts are carried out by taking action starting from cyber patrols, investigations, investigations and submission of case files in accordance with the provisions of procedural law in the ITE Law and KUHAP if there are procedural law provisions that are not specifically regulated in the ITE Law. The various obstacles faced by the DIY Police include the lack of public participation and awareness of the law, the number of fake accounts used for online gambling promotions, the lack of sophisticated facilities owned, the lack of personnel in the cyber team, and the number of online gambling sites that use foreign servers.
